THIS AGREEMENT CONTAINS A RELEASE OF LIABILITY AND WAIVER OF LEGAL RIGHTS, INCLUDING CLAIMS FOR NEGLIGENCE. PLEASE READ CAREFULLY BEFORE SIGNING.
This Rental Equipment Agreement and Waiver of Liability (“Agreement”) is entered into between Lazy Rock RV Park & Campground (“Lazy Rock”), located at 28 Taggart Lake Rd, Papineau-Cameron/Mattawa, Ontario, P0H-1V0, and the undersigned Participant.
Participant:
By signing this agreement, the Participant acknowledges and agrees to the following terms regarding participation in Water Activities at Lazy Rock RV Park & Campground.
For the purposes of this agreement, “Participant” includes any person using, riding in, operating, or otherwise participating in Water Activities involving rental equipment provided by Lazy Rock RV Park & Campground.
For the purposes of this agreement, “Water Activities” includes the use of canoes, kayaks, paddle boats, paddle boards, fishing kayaks, and other rental watercraft, as well as the loading, unloading, boarding, exiting, and handling of equipment on docks, shorelines, launches, and adjacent park premises, and related recreational activities.
**Assumption of Risk**
The Participant understands that Water Activities involve inherent risks, including the risk of injury, drowning, property damage, illness, or death. These risks may result from factors including, but not limited to, weather, water conditions, equipment failure, falling, collisions, changing lake conditions, the actions of other participants, operator error, wildlife, and natural hazards associated with outdoor recreational activities.
The Participant understands that safety equipment reduces risk but does not eliminate all dangers associated with Water Activities.
Participants are responsible for securing their own personal property, including phones, cameras, electronics, fishing gear, and valuables. Lazy Rock RV Park & Campground is not responsible for loss, theft, or damage to personal property during Water Activities.
The Participant voluntarily accepts and assumes all risks associated with participating in Water Activities.
**Safety Acknowledgment**
The Participant understands that properly fitted personal flotation devices (PFDs/lifejackets) are required while using rental equipment. Lazy Rock RV Park & Campground provides required safety equipment for the rental watercraft, including PFDs and other safety equipment required by applicable boating regulations.
Participants may choose to use their own properly sized and legally compliant PFDs at their own discretion and responsibility.
The Participant confirms that they have reviewed and understood the provided safety briefing and instructions related to the use of the rental equipment.
The Participant understands that any online resources, videos, maps, or safety materials provided by Lazy Rock RV Park & Campground are intended as general safety information only and are not a substitute for formal boating instruction or certification.
The Participant agrees to operate all rental equipment safely, responsibly, and in accordance with all applicable provincial, federal, and local laws and boating regulations.
The Participant confirms they have made reasonable preparations for safe participation in the planned activity.
The Participant is responsible for complying with all applicable boating laws and regulations and for any violations occurring during their use of rental equipment.
Lazy Rock RV Park & Campground reserves the right to refuse or terminate rentals where unsafe conditions, weather, participant conduct, impairment, or safety concerns exist.
The Participant agrees not to operate rental equipment while under the influence of alcohol, cannabis, drugs, or any impairing substance.
**Condition and Use of Equipment**
The Participant agrees to inspect the rental equipment prior to use and to immediately report any concerns or visible damage to Lazy Rock RV Park & Campground before participating in Water Activities.
Use of the rental equipment constitutes acknowledgment that the equipment appeared acceptable for its intended recreational use at the time participation began.
The Participant confirms they are physically capable of participating in the planned activity and have sufficient knowledge, experience, or understanding to operate the equipment safely.
The Participant agrees to use all rental equipment only for its intended purpose and to return all equipment in the same condition in which it was received, reasonable wear and normal outdoor recreational use excepted.
**Damage, Loss, and Cleaning**
The Participant accepts responsibility for any loss, theft, or damage to the rented equipment during the rental period.
The Participant agrees to return all equipment in reasonably clean condition considering normal outdoor recreational use, including exposure to sand, mud, water, fish, and similar conditions associated with Water Activities.
Additional cleaning or repair charges may apply if equipment is returned with unusual or excessive mess, damage, staining, odors, waste, or other conditions requiring significant additional cleaning, repair, or restoration beyond normal recreational use.
The Participant agrees not to misuse, intentionally damage, tamper with, or remove safety equipment from any rental equipment.
**Minors**
Any participant under the age of majority must have this agreement signed by a parent or legal guardian.
By signing on behalf of a minor participant, the parent or legal guardian confirms they have reviewed this agreement, accept its terms on behalf of the minor, and accept responsibility for the minor’s participation in Water Activities.
The parent or legal guardian agrees to be responsible for the minor participant’s conduct, compliance with safety instructions, and any damage or loss arising from the minor participant’s participation in Water Activities.
**Release of Liability**
Participant hereby RELEASES, WAIVES, and HOLDS HARMLESS Lazy Rock RV Park & Campground, its owners, employees, agents, and representatives from claims, demands, damages, losses, actions, or causes of action arising from participation in Water Activities, including claims arising from the negligence of Lazy Rock RV Park & Campground, its owners, employees, agents, or representatives.
**General Terms**
This agreement is governed by the laws of the Province of Ontario, Canada.
This Agreement constitutes the entire agreement between the parties relating to the Water Activities and supersedes any prior verbal or written statements or agreements.
If any portion of this agreement is found to be invalid or unenforceable, the remaining portions shall remain in full force and effect.
**Acknowledgment**
By signing below, the Participant confirms that they have read and understood this agreement, had the opportunity to ask questions, and voluntarily agree to its terms.
The Participant may request a paper or electronic copy of this agreement at any time.
