ASSUMPTION OF RISK, WAIVER, RELEASE OF CLAIMS AND INDEMNITY

Please read this document (the “Waiver”) carefully, as it affects your legal rights.

As used hereunder, the term “Releasees” includes: LAZY ROCK (o/o Charisma Haight and Jonathan Keller) Lazy Rock RV Park & Campground 28 Taggart Lake Rd Papineau-Cameron Ontario P0H 1V0 (the “Campground” or the “Premises”), affiliated organizations, owners, members, managers, directors, officers, employees, agents, representatives, successors and assigns.

In consideration for myself, and all persons entering under my supervision, being permitted to camp and participate in the activities at this Campground, I and all persons listed below agree as follows: :

We expressly acknowledge and agree that attending the Premises and participating in activities at the Campground may involve significant risks, including the potential for serious injury, death, or property damage.

We are fully aware that we are entering a natural environment and understand the inherent risks and hazards associated with attendance at the Premises and participation in Campground activities. These risks include, but are not limited to:

Our own actions or inactions.
The actions or inactions of others, including but not limited to the Campground’s owners, officers, directors, managers, staff, volunteers, other guests, or visitors.
Falls, injuries, illnesses, infections, and exposure to natural or environmental elements.
Navigating obstacles or encountering defects in the Premises.

We acknowledge that attendance at the Campground and participation in its activities may involve exposure to communicable diseases or illnesses, including but not limited to respiratory or viral infections. We understand and accept that, despite any reasonable precautions taken by the Campground, there is an inherent risk of exposure to communicable illnesses. We freely and voluntarily assume these risks on behalf of ourselves and all individuals in our group, listed or unnamed, who are accompanying us on this reservation.

By signing this Waiver, we confirm that all persons under our supervision:

Are in good physical condition and capable of safely participating in Campground activities.
Have no medical conditions that would make participation hazardous.
Have consulted a physician if recently ill, injured, pregnant, or otherwise physically vulnerable.

In the event of a medical emergency, we consent to the Campground contacting emergency services (e.g., ambulance, paramedics) on behalf of ourselves or any members of our group. We understand that any associated costs for medical transportation or treatment are the responsibility of the injured party and not the Campground.

We also agree to abide by all local, provincial, and federal laws, as well as the Campground’s rules and policies, including those posted onsite or communicated by staff. This includes but is not limited to:

Acting respectfully toward other individuals, property, equipment, and facilities.
Refraining from bringing weapons or illegal substances onto the Premises.

Guests are responsible for securing their personal belongings. We understand and agree that the Releasees are not liable for any personal property that is lost, damaged, or stolen while attending the Campground or participating in its activities.

We recognize and accept that there are risks and hazards that cannot be entirely eliminated, and we freely and voluntarily assume all such risks, including but not limited to the risk of death, bodily injury, or property damage, regardless of severity or how such risks arise.

Having full knowledge and understanding of the above, I, on behalf of myself, my minor children (or wards), all persons listed above, and our heirs, expressly accept and voluntarily assume all risks of injury, death, illness, disease, or damage to ourselves or our property. These risks may arise from entering or remaining on the Premises or participating in Campground activities, including but not limited to natural environmental hazards (e.g., falling trees, severe weather, lightning), or any risks not specifically mentioned herein.

I release, covenant not to sue, indemnify, and hold harmless the Releasees from any and all claims, losses, liabilities, damages, demands, costs, or penalties of any kind, arising from attendance at the Premises or participation in Campground activities, including claims for ordinary negligence. This waiver does not release the Releasees from liability for gross negligence, willful misconduct, or reckless disregard for safety.

This Waiver and Release are intended to be as broad and inclusive as permitted by the law of the Province of Ontario, including but not limited to the Occupiers’ Liability Act, R.S.O. 1990, c. O.2, and the Negligence Act, R.S.O. 1990, c. N.1. Any disputes shall be governed by Ontario law and resolved exclusively in Ontario courts. If any provision is found invalid or unenforceable, the remaining provisions remain binding.

I accept full responsibility for myself and all individuals in my group, including those listed on this waiver or accompanying me, and agree to communicate all Campground rules, policies, and safety guidelines to my group and ensure compliance.

I confirm that I have read and fully understand this document. I am signing freely and voluntarily, acknowledging that I am waiving substantial legal rights, including the right to sue the Releasees, and assuming all inherent risks associated with the Campground.
